Sending a copyright notice

Please include the following in a written DMCA notice:

  1. Your physical or electronic signature as the copyright owner or a person authorised to act on their behalf.
  2. Identification of the copyrighted work, or a representative list if the notice covers multiple works at one online site.
  3. Identification of the material you believe infringes copyright, with links or other details sufficient for us to locate it.
  4. Your contact details, including your address, telephone number and email address, if available.
  5. A statement that you believe in good faith that the use is not authorised by the copyright owner, their agent or the law.
  6. A statement that the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the exclusive right allegedly infringed.

Counter-notices

When we remove or disable access to material because of a copyright notice, we promptly tell the user who uploaded or posted it.

If you believe material was removed or disabled by mistake or misidentification, you can send a counter-notice to our designated copyright agent. Please include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and where it appeared before it was removed or disabled.
  3. A statement, under penalty of perjury, that you believe in good faith the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, any judicial district in which Loose Loop Limited may be found, and that you will accept service of process from the person who sent the original notice or their agent.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them we will restore the material in 10 business days. We restore it between 10 and 14 business days after we receive the counter-notice, unless our designated agent first hears from that person that they have filed a court action seeking an order to stop the user infringing.

Repeat infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. This applies to all users of the LooseLoop app and website, including designers selling on the Marketplace.

We keep a record of the valid notices we receive about each account.

We may also suspend or terminate an account after a single notice where the infringement is serious.

Misrepresentations

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
